1. Acceptance Of Terms

Your access to and use of www.gusto-deli.com ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

2. Definitions in these conditions

‘Goods' means the goods in your shopping basket at the time of ordering. It includes any service that comes with any goods.

‘Product or Products' means Gusto Deli good(s)

‘we', ‘us', ‘our' means Tide (The Italian Deli Experience) Limited t/a Gusto Deli
‘you', ‘your', means one of our customers

3. Product availability

To maintain our high standards and freshness of product, some fresh products will be limited and at times unavailable. In the event of a particular Product being unavailable we reserve the right to substitute a similar product of equal or higher value or ship the remaining items on your order. We will make reasonable efforts to contact you first.

4. Content and photography

The information provided for each product or collection of products is accurate at the time we published the information. Where the product is a collection of many products, such as our hamper ranges, a full list is supplied. We sometimes use props in our photography, in these cases the product description or list clearly defines what is being advertised for purchase.

5. Basis of sale

When you click on 'Complete Order' you offer to buy the Goods at the prices indicated including any delivery charges that apply to your purchase.

All orders will be subject to these conditions.

If your order is accepted, a confirmation will be sent to the email or postal address you provided when placing your order. As the confirmation is sent to you automatically, an error may have been made of which we are not aware despite our best efforts. Because of this, we retain the right to cancel the order as set out under the 'Cancellation and return' heading.

6. Acceptance of order

Your order becomes binding as soon as we have accepted it, subject to your rights of cancellation. Your order will be accepted as soon as we have confirmed your order. Our acceptance of your order is conditional on the availability of the Products you have ordered. If any of the Products you have ordered are unavailable, or should events occur beyond our reasonable control, we reserve the right to cancel your order without liability. In such circumstances we shall let you know as soon as possible.

Pursuant to the Licensing Act 1964 it is an offence for any person under the age of 18 to buy intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18, subject to a maximum fine on conviction of £1000.

7. Returns & Refunds:

We will happily offer a refund or exchange on unsuitable products if returned within 14 days. Items must be returned unused and in the original packaging accompanied by the relevant invoice.

When returning items we advise using a signed for method of postage as we cannot be held responsible for items lost in transit. We will not refund the cost of postage of returned goods.

This does not affect your statutory rights.

8. Secure Payments:

We process all on-line transactions using Sage Pay ensuring your card details are never viewed by anyone but your credit card provider. No goods will be dispatched until credit/debit card transactions have been authorised and payment received.

All prices are VAT inclusive at the current rate (where applicable). VAT receipts are available on request.

9. Privacy:

We fully adhere to the UK Data Protection Act and will not pass on customer details to any third party. Please see our Privacy Policy.

10. Delivery:

UK and Northern Ireland: £7.50

11. Christmas produce delivery and rates

Christmas produce including hampers will be dispatched individually and specific additional delivery terms and conditions may apply. This information will be available with the product details.

We guarantee all hamper orders for UK delivery will arrive in time for Christmas if placed before 12th December and all other orders if placed before 19 th December, subject to availability.

Orders for non UK delivery must be placed before 5 th December to guarantee delivery in time for Christmas.

If you require a hamper delivery on a specific week please clearly request the date you require at time of placing your order.

Hampers and other collections or products have a specific delivery charge. These charges are clearly identified in the product information detail.
